Definitions
“Service” means the Fitrah mobile application and related features we make available. “You” means the individual using the Service. Terms capitalised in the Privacy Policy have the same meaning here unless stated otherwise.
Acceptance of terms
By downloading, installing, accessing, or using the Service, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the Service.
Eligibility & age
You must be at least 13 years old to use the Service, or the minimum age required in your country if that is higher. If you are under the age of majority where you live, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. The Service is not directed at children under 13.
License to use the Service
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the Service on devices you own or control, in accordance with the rules of the app store from which you obtained Fitrah.
Restrictions
You agree not to:
- Copy, modify, distribute, sell, lease, or publicly display any part of the Service except as allowed by applicable law or with our prior written consent.
- Reverse engineer, decompile, or attempt to extract the source code of the app, except where applicable law expressly permits this despite this restriction.
- Use the Service to break the law, harm others, harass, discriminate, or transmit unlawful, hateful, violent, or sexually exploitative material.
- Interfere with or disrupt the Service, servers, or networks, or use automated means (including bots or scrapers) not expressly authorised by us.
- Circumvent technical limits, security measures, or payment or access controls.
Intellectual property
The Service, including branding, user interface, software, and original materials we provide, is owned by NorthForge Tech or our licensors and is protected by copyright, trade mark, and other intellectual property laws. Quranic text, typography, audio recitation, or other materials may be included under public-domain status, open licences, or commercial licences we have obtained. Your licence to use those materials is limited to personal, non-commercial use through the Service unless we say otherwise in writing.
Except for the limited licence above, no rights are granted to you.
User conduct
You will use the Service respectfully and lawfully. We may suspend or limit access to the Service if we reasonably believe you have breached these Terms, created security or legal risk, or misused features (for example abusive use of AI inputs), subject to applicable law and app store policies.
AI features (“Ask a Question”)
Optional AI features may produce incorrect, incomplete, or inappropriate content. They are not fatwa, medical advice, legal advice, or crisis counselling. You are solely responsible for how you interpret or act on AI output. For emergencies, contact local emergency services; in the United States you may contact the 988 Suicide & Crisis Lifeline (call or text 988).
Processing may involve third parties (for example Google / Firebase) as described in our Privacy Policy.
Third-party services
The Service relies on third parties, including Apple (App Store, iOS platform features) and Google (Google Play, Android platform features, Firebase, cloud and AI services). Your use of those platforms is also governed by their terms and privacy policies. We are not responsible for third-party services we do not control.
Disclaimer of warranties
The Service is provided “as is” and “as available.” To the maximum extent permitted by applicable law, we disclaim all implied warranties, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that prayer times, qibla direction, or AI answers will always be accurate for your situation. Tools in the app support your personal practice but do not replace qualified scholarship, medical care, or legal advice where you need it.
Some jurisdictions do not allow certain disclaimers; in those jurisdictions our warranties are limited to the extent permitted by law.
Limitation of liability
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or other liability that cannot lawfully be limited.
Subject to the paragraph above, to the maximum extent permitted by applicable law, NorthForge Tech and its directors, officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the Service.
Subject to the first paragraph of this section, our total aggregate liability for all claims arising out of or related to the Service in any twelve (12) month period is limited to the greater of: (a) the amount you paid to NorthForge Tech for the Service in that period, or (b) one hundred US dollars (USD 100) if you did not pay us during that period (for example while the Service is free).
If you are a consumer in the European Union, United Kingdom, or another jurisdiction with mandatory consumer protections, you may have rights that cannot be waived; those rights remain in force.
Indemnity
To the extent permitted by applicable law, you agree to indemnify and hold harmless NorthForge Tech and its directors, officers, employees, and affiliates from any claims, damages, losses, liabilities, and reasonable legal fees arising from your misuse of the Service, your breach of these Terms, or your violation of third-party rights, except to the extent a claim arises from our wilful misconduct or gross negligence.
If you are a consumer in a jurisdiction that does not permit this kind of indemnity, this section applies only to the extent permitted by the laws that apply to you.
Governing law & disputes
These Terms are governed by the laws of England and Wales, without regard to conflict-of-law rules that would apply another jurisdiction’s laws, except that mandatory consumer protections in the country where you live as a consumer remain unaffected.
If you are not a consumer, or you agree contractually to this forum, the courts of England and Wales have exclusive jurisdiction over disputes arising from these Terms or the Service, except that we may seek injunctive relief in any court of competent jurisdiction.
If you are a consumer resident in the European Union (other than the United Kingdom), you may also bring proceedings in the courts of your country of residence. If you are a consumer resident in the United Kingdom, you may bring proceedings in the courts of England and Wales or in the courts of the part of the UK where you live, as permitted by UK law.
Purchases & subscriptions
Fitrah is currently offered without in-app purchases. If we introduce paid features, payment will be processed by Apple and/or Google. Paid digital content obtained through Apple’s App Store may also be subject to Apple’s applicable terms, including Apple’s Licensed Application End User License Agreement (EULA), unless Apple’s guidelines require a custom EULA, in which case the applicable EULA linked in the App Store listing will apply. We will publish separate subscription terms before any recurring paid plan goes live, where required by Apple or Google.
Termination
You may stop using the Service at any time by uninstalling the app. We may modify, suspend, or discontinue the Service (in whole or in part) with reasonable notice where practicable, or immediately where required for security, legal compliance, or serious abuse. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law, to the extent enforceable) survive termination.
